DeSantis claims ‘legislative immunity’ in bid to dismiss Disney lawsuit

Florida’s Republican governor Ron DeSantis is seeking to dismiss Disney’s federal lawsuit against him, claiming that he has “legislative immunity”.

DeSantis’s legal team filed a motion to dismiss the case on Monday, June 26, arguing that the federal court “lacks jurisdiction” over the governor.

“Although Disney grabbed headlines by suing the governor, Disney – like many litigants before it who have challenged Florida’s laws – has no basis for doing so.

“Neither the governor nor the secretary of the Florida Department of Economic Opportunity enforce any of the laws at issue, so Disney lacks standing to sue them,” the motion read.

Disney has declined to comment at this time.

The move is the latest development in a 15-month feud between the governor and the entertainment giant. The feud began in March 2022, after the company suspended political donations in Florida following public pressure in response to the state’s controversial ‘Don’t Say Gay’ bill, which prevents teachers from discussing LGBTQ+ people and issues in schools.

Since then the feud has seen Disney and DeSantis file lawsuits against each other after DeSantis took control of Disney World’s special governing district. In response, Disney invoked the Royal Lives Clause to strip the DeSantis-appointed board of its powers.
